1. Agreement
These Terms of Service ("Terms") govern your access to and use of the SiteLekha mobile application and related services ("Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use SiteLekha.
2. The Services
SiteLekha provides tools for contractors and site managers to manage construction or project sites, workers, attendance, expenses, documents, notifications, and related operational data. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Eligibility and accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must comply with applicable laws and obtain any consents needed for worker or third-party data you enter into the app.
4. Your content and data
You retain rights to data you submit. You grant SiteLekha a license to host, process, and display that data solely to provide and improve the Services (including backups, security, and support). You represent that you have the right to submit the data you upload.
5. Acceptable use
You agree not to:
- Use the Services for unlawful purposes or to violate others' rights
- Attempt to gain unauthorized access to systems, accounts, or data
- Reverse engineer or scrape the Services except where permitted by law
- Upload malware or interfere with the integrity or performance of the Services
6. Subscriptions and fees
Paid plans, billing cycles, and taxes (if any) are described in the app or checkout flow. Failure to pay may result in suspension of paid features. Unless required by law or stated otherwise, fees are non-refundable.
7. Third-party services
The Services may rely on third parties (e.g. cloud hosting, app stores, payment processors). Their terms and privacy practices may also apply.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SiteLekha is not a substitute for professional legal, accounting, or safety advice.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITELEKHA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) A NOMINAL AMOUNT WHERE NO FEES WERE PAID, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
10. Indemnity
You will defend and indemnify SiteLekha and its affiliates against claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, legal requirements, or risk to the Services. Provisions that by nature should survive will survive termination.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts at a competent location in India shall have exclusive jurisdiction, subject to those mandatory rules.
13. Changes
We may update these Terms. We will post the revised version and update the "Last updated" date. Continued use after changes constitutes acceptance where permitted by law.
